2. The petitioner is in custody in connection with Kopa P.S. Case No. 72 of 2025 for the offence punishable under Section 309(4) of the B.N.S. and Section 27 of the Arms Act lodged on 12.04.2025 by the informant, Manu Kumar.
3. As per the prosecution story, the informant alleged that while he was driving the truck, a Scorpio vehicle without number plate intercepted, on the pretext of checking, they took Rs. 19,300/- as also mobile phones. This led to the FIR.
4. Learned counsel for the petitioner submits that this petitioner alongwith Munna Kumar were picked up and thereafter the house of Munna Kumar was raided and one of the mobile was recovered, however, the same was not put to T.I.
Patna High Court CR. MISC. No.42735 of 2025(4) dt.15-11-2025 2/3 inspection and further submission is that Munna Kumar Chaudhary has been granted bail in Cr. Misc. No. 40965 of 2025 on 20.08.2025 by a Coordinate Bench and the last submission is that he do not have criminal antecedent.
5. Mr. Jitendra Kumar Singh, learned APP opposes the prayer for bail submitting that they were picked up and on confession, a mobile was recovered/seized.

Taking into account the submission of the parties as also that he is in custody since 13.04.2025, has no criminal antecedent, similar situate Munna Kumar Chaudhary has been granted bail, as recorded above, in that background, this Court is inclined to extend him the privilege of bail with conditions.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in connection with Kopa P.S. Case No. 72 of 2025 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive

(iii) the petitioner shall appear before the concerned police station every fortnight for six months to mark his attendance and after the end of the period, the certificate shall be submitted before the Trial Court failing which steps shall be taken for the cancellation of the bail bonds; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
