The petitioner apprehends his arrest in connection with Tatarpur P.S. Case No. 114 of 2018, registered under Section 392 and 120(B) of the Indian Penal Code, pending in the court of the Addl. Chief Judicial Magistrate-VII, Bhagalpur. The accusation is that three persons surrounded the informant Kunjbihari, who was going to Bhagalpur at the house of his relative on 18.06.2018, and snatched his mobile and cash of Rs. 7000/-. The informant detailed the physique and age of the culprits saying that he can identify them on seeing them again.
Learned counsel appearing on behalf of the petitioner submits that the name of the petitioner has been
Patna High Court CR. MISC. No.41480 of 2019(2) dt.05-07-2019 2/2 surfaced in the confessional statement of Md. Ali, who has inimical term with the petitioner.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner and also the claim of the informant to identify the culprits on seeing them again, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
