JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2024 The present writ petition has been filed seeking the following relief:- "1(i). For direction to the concerned respondents for setting aside the order dated 25.05.2021 passed by Deputy Inspector General of Police (DIG) Eastern Zone Bhagalpur, in departmental Enquiry No. 28/2019 whereby and whereunder he has affirmed the dismissal order dated 19.02.2021 Memo No. 735, passed by senior superintendent of Police, Bhagalpur.

(ii). For setting aside the order dated 30.05.2021, passed in District Order No. 472/2021 issued under the signature of superintendent of Police,

Patna High Court CWJC No.16470 of 2021(2) dt.24-01-2024 2/2 Lakhisarai.

(iii). For setting aside the order dated 19.02.2021 Memo No. 735 passed under the signature of senior superintendent of Police, Bhagalpur.

(iv). For direction to the concerned respondents to reinstate the petitioner in service with all consequential benefits."

At the outset, the learned counsel for the RespondentState submits that the petitioner had filed an appeal before the Additional Director General of Police (Budget, Appeal and Welfare), which has been allowed, as is apparent from the order dated 11.3.2022, issued by the Administrative Officer-cumSenior Superintendent of Police, Bhagalpur and the order of dismissal of the petitioner from service has been set aside, the matter has been remanded back to the disciplinary authority for conducting the disciplinary proceeding in question afresh as also it has been directed to reinstate the petitioner back in service, forthwith, hence, it is submitted that the present writ petition has been rendered infructuous.

Accordingly, the present writ petition stands disposed off as having been rendered infructuous.
