JUSTICE SATYAVRAT VERMA ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the complainant. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323 and 498(A) of the Indian Penal Code.

Learned counsel for the petitioner draws the attention of the Court to order dated 21.12.2022 wherein it has been recorded that both petitioner and the opposite party no. 2/complainant were willing to accompany each other along with their children to Assam. It is further submitted that petitioner and the opposite party no. 2/complainant are living happily

Learned counsel for the complainant also accepts the submission of the learned counsel for the petitioner and submits that he has instruction not to oppose the prayer for anticipatory bail of the petitioner.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 1389 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
