Petitioner apprehends his arrest in connection with Minapur P.S. Case No. 325 of 2017, registered for the offences punishable under Sections 366, 366A and 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of twelve years daughter of the informant.

Submission of learned counsel for the petitioner is that statement of the victim girl was recorded under Section 164 Cr.P.C. before Magistrate and her age was assessed at eighteen years and she disclosed in her statement that her age was seventeen years and she had gone on her own sweet will. Heard learned APP also.

No.10387 of 2018 (4) dt.11-05-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, above named, surrender within a period of four weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Minapur P.S. Case No. 325 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned and further condition is that he has to co-operate in investigation otherwise his bail bond shall be cancelled.
