The petitioner has preferred this application for grant of regular bail in a case registered under sections 456, 354 and 354B of the Indian Penal Code and sections 8 and 12 of the POCSO Act.

As per the prosecution case, the petitioner is said to have entered the hut of the informant and of having misbehaved with the five year old niece of the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The petitioner is in custody since 4.4.2021 and charge sheet has been submitted in the case.

It is submitted by learned APP appearing for the State that there is direct allegation against the petitioner and charge

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner having remained in custody for more than 1 year and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Spl. (POCSO) Case no. 51 of 2021 (arising out of Kankarbagh P.S. Case no. 354 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge -VIcum-Spl.
