The petitioners seek regular bail in connection with Kankarbagh Police Station Case No. 380 of 2020, registered for the offences punishable under Sections 413/414/34. The prosecution story, as per the First Information Report, is that the police got secret information that petitioners, who are full brothers, along with other co-accused persons, have kept stolen four numbers of four-wheeler vehicle and three numbers of two-wheeler vehicle at their residence, proceeded towards the place of occurrence and recovered four numbers of four-wheeler vehicle and three numbers of two-wheeler vehicle

Learned Counsel for the petitioner submits that the petitioners have not committed any offence in the manner alleged and they have falsely been implicated in this case with oblique motive. He further submits that the petitioners have got no criminal antecedent and out of the seven vehicles, which were recovered, the father of the petitioners is the owner of the two numbers of two-wheeler motorcycle and the said motorcycles have been released in favour of the father of the petitioners by learned Court below, vide order, dated 04.12.2020.
On the other hand, learned Additional Public Prosecutor submits that a huge number of stolen vehicles have been recovered from the possession of the petitioners and the petitioners appear to be professional criminals, who deal in stolen vehicles. He further submits that the ownership of the two motorcycles, which were released in favour of the father of the petitioner, were transferred in favour of the father of the petitioners after registration of the present First Information Report.
Having heard learned Counsel for the parties and taking into consideration the materials on record, particularly
Patna High Court CR. MISC. No.40253 of 2020(4) dt.26-03-2021 3/3 the nature of allegation and recovery of huge number of vehicles from the possession of the petitioners, I am not inclined to grant regular bail to the petitioners.
This application is, accordingly, dismissed.
