JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2018 Petitioner apprehends hisarrest in connection with Parihar P.S.Case No. 53 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.

Allegation as per FIR is that some persons were committing theft of motorcycle of the informant and informant woke up and raised alarm and one person was apprehended and he disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and petitioner has enmity with the person who has disclosed his name. It is further submitted that earlier case was not found true but later on he has been made accused and he is a student.

Patna High Court Cr.Misc. No.13698 of 2018 (4) dt.19-06-2018 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner..

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and disposed of, if possible, on the same day.
