Petitioners apprehend arrest in a case registered for the offence punishable under Sections 363, 366(A)/34 of Indian Penal Code.

As per prosecution case, all the FIR named accused persons including these petitioners kidnapped the minor daughter of the informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in

Patna High Court CR. MISC. No.45364 of 2022(2) dt.06-12-2022 2/2 this case. They have been made accused only because they happen to be relative of co-accused Ranjit Kumar. Moreover, victim in her statement recorded under Section 164 of Cr.P.C. has categorically stated that she voluntarily left the house and went to village Bharwaliya. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in Basantpur P. S. Case No. 487 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
