The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bhagwanpur P.S. Case no. 58 of 2022 instituted for the offence under Sections 341, 323, 307, 420, 467, 384, 354 (B), 379 of the Indian Penal Code.

As per allegation in the FIR, some unknown persons came at the land of the informant and co-accused namely Raja Ram Choudhary started threatening the informant at the point of pistol and told the informant not to uproot the grass of the said land. Allegation against the petitioner is that he pressed the neck of the informant with intention to kill him. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.44986 of 2022(2) dt.13-12-2022 2/2 has submitted that petitioner is innocent and has committed no offence. In fact, informant has forcibly try to capture the land of the petitioner. He has got no criminal antecedent. Section 307 IPC is not made out against the petitioner because no injury report of such injury has been produced by the informant. The alleged occurrence took place over a land dispute. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Bhagwanpur P.S. Case no. 58 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Begusarai subject to the conditions as laid down under section 438(2) of the Cr.P.C.
