1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 118(1), 352, 351(3) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that a protest was made by the mother of the informant against selling of illicit liquor by co-accused Ramu Bin, when all the accused persons came variously armed and assaulted. It is further alleged that on account of assault made by Ramu Bin,
Patna High Court CR. MISC. No.43369 of 2026(2) dt.16-07-2026 2/3 the mother of the informant sustained injury on head and when his sister came to rescue of her mother, she was also assaulted causing injury on hand.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegations as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioners. It is next submitted that Bechu Bin along with five others had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous Number 50219 of 2025 and the same came to be allowed by an order dated 18.11.2025 passed by a Learned Coordinate Bench. It is thus submitted that the learned counsel based on parity seeks anticipatory bail. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned
Patna High Court CR. MISC. No.43369 of 2026(2) dt.16-07-2026 3/3 trial court where the case is pending/successor court in connection with Kateya P.S. Case No. 374 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
