The petitioner apprehends his arrest in a case registered for the offences punishable under Section 366 of the Indian Penal Code.

Prosecution case in brief is that petitioner kidnapped the wife of informant.

It is submitted that the victim lady in her statement under Section 164 Cr.P.C has denied the allegation of kidnapping and stated that out of her sweet will she had gone with the petitioner to Patna. The victim lady has stated her age to be 19 years. The medical Board also assessed her age 17-19 years. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner above-

Patna High Court CR. MISC. No.45123 of 2022(2) dt.06-12-2022 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 55 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
