JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioner is apprehending his arrest in connection with Motihari Nagar P.S. Case No. 338 of 2014 registered for offences punishable under Sections 406, 420, 447, 467, 471, 119, 167, 120B, 34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that whatever the allegation has been levelled, that is against the father of the petitioner, as the sale deed was executed in the name of father of the petitioner and the same has been mutated on his name and the nature of allegation is also a civil dispute, as allegation has been levelled against the petitioner that he got sale deed executed from a fictitious person and got the land mutated, though the land is in the name of the informant. Heard learned A.P.P. also.

Having heard both sides and in view of the nature of

Patna High Court Cr.Misc. No.9926 of 2017 (2) dt.06-03-2017 2/2 the allegation which is against the father of the petitioner has also named in the case, as such, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs.25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari, in connection with Motihari Nagar P.S. Case No. 338 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is further subject to the condition that the petitioner shall cooperate in the investigation of the case and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive occasions, his bail bond shall be liable to be cancelled.
