As per the claim of the petitioner, he was appointed in the year 1985 on the post of Typist in the office of the Director, Secondary Education, Patna, in the pay scale of Rs.580-660/- and whereafter he was appointed as Steno-typist in the office of the Director, Secondary Education, Patna, on 03.06.1989. Whereafter, the pay scale of Steno-typist and Typist has been merged with effect from 01.01.1996 in the pay scale of Rs.4000-6000/-, claiming that the petitioner is entitled to the M.A.C.P., which has not been allowed by the respondent authorities.

Patna High Court CWJC No.13171 of 2016 dt.26-11-2018 2/2 In this connection, the petitioner has filed a representation before the competent authority on 27.06.2016, but the same is still pending before the competent authority 3.

Let the competent authority look into the grievance of the petitioner with regard to entitlement of the M.A.C.P. as per the M.A.C.P. Rules. For convenience, the petitioner is directed to file a fresh representation along with the copy of this order and give entire facts. If such a representation is filed, the competent authority shall consider and decide the same within a period of five moths from the date of filing of representation by the petitioner. If it is found that the petitioner is entitled to M.A.C.P., it goes without saying, that the same will be given to the petitioner from the due date.

With the aforesaid observations and directions, this writ petition is disposed of.
