JUSTICE ALOK KUMAR PANDEY ORAL ORDER 15-07-2025 In the instant petition, the petitioner has prayed for following relief(s):- "That by this writ application the petitioner seeks for issuance of an appropriate writ or writs, order and direction to the Respondent No.6, the Circle Officer, Office Patna Sadar, Patna to initiate the proceeding for mutation and for realization of rent from the petitioner in Mutation Case No.117612R27/20222023/Patna Sadar which is pending of

2/4 Residential Flat No.103, Supper Buildup Area 830 Barge feet situated at Chandra Mani Apartment First Floor and Car parking space reserved in Ground Floor and common area 348.59 Barge feet without distributed in the said land MauzaChitkohra, Survey Thana-Phulwari Sharif, at present Thana Gardanibag, Sadar Registry Office Patna, Thana No.17 (Seventeen), Maliankam No.114, Jon 3, Tauzi No.5247, Khata No.334 (three hundred thirty four) Survey Plot No. 2201 (Two Thousand Two hundred one) Ka Ans Patna Municipal Corporation Ward No.8 at present Ward No.16 Circle No.262 As, A, As. No. P.M.C./16/1187038 and the said case is pending with observation that in connection with the said land, no any receipt or no any Jamabandi Number is mentioned in the said attached documents, inspite of the facts, subsequently, the petitioner filed the Jamabandi Panji Prati and others paper as the rent receipt from the year 2022-2023 to 2023-2024 of Patna Municipal Corporation but no any action has been taken up till now and is still pending."

2. Learned counsel for the petitioner submits that petitioner purchased a residential flat bearing Flat no. 103 on the 1st floor of Chandra Mani Apartment, situated at MauzaChitkohra, Survey Thana-Phulwari Sharif, at present Thana-

3/4 Gardanibag, Sadar Registry Office, Patna appertaining to Thana No. 17, Maliankam No.114, Jon 3, Tauzi no.5247, Khata No.334, Survey Plot No.2201 in the name of his wife Smt. Sarika Verma on 29.09.2021 from Prince Raj, son of Dadan Prasad through registered sale deed as mentioned at Annexure-1 of the present writ petition. He further submits that the petitioner has filed Mutation Case No.117612R27/20222023/Patna Sadar in which objection was raised mentioning the documents required for mutation for further proceeding, as contained in Annexure-3. He further submits that he has filed Jamabandi Panji Prati and other papers and the rent receipt of Patna Municipal Corporation from the year 2022-23 to 2023-24 but no action has been taken uptill now. He further submits that in the light of direction given by the concerned Circle Officer, Patna Anchal, as mentioned at Annexure3 of the present writ petition, he has supplied all the documents which has needed.

3. Learned counsel for the State submits that concerned Circle Officer will look into the matter for initiating mutation proceeding.

4. Considering the facts and circumstances of the case and the arguments advanced on behalf of both the parties, the present writ petition stands disposed of with direction to the

4/4 concerned authority to pass appropriate order in the light of the grievances, which has been raised in the present writ petition, as petitioner has already supplied all the documents relating to mutation, by giving him due opportunity of hearing as per provision of law without being prejudiced by the order passed by this court within a period six weeks from the date of receipt of the order.
