ANJANA MISHRA ORAL ORDER 02-03-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 29.7.2013 in connection with Tekari P.S. Case No.201 of 2013 instituted under Sections 302 and 201/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the petitioner is the brother-in-law of the deceased and that the deceased is the husband of his sister, who had come to live with them. It is further submitted that the petitioner and his entire family have been roped in the present case merely on the basis of suspicion and there was no dispute whatsoever between them. In fact, the deceased had been living peacefully in his house but on account of the fact that he had differences with his father over

Patna High Court Cr.Misc. No.30418 of 2014 (4) dt.02-03-2015 2/2 partition of ancestral property, he left his house. Learned counsel for the petitioner submits that all other accused persons except this petitioner have been extended the privilege of bail by this Hon'ble Court in Cr. Misc. No.12090, 11717, 11420 all of the year 2014, vide orders contained in the supplementary affidavit. Considering the aforementioned facts and circumstances and also the fact that there is no cogent material in the case diary to connect the petitioner with the alleged occurrence, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Tekari P.S. Case No.201 of 2013 (G.R. No.2826 of 2013).
