Petitioners apprehend arrest in a case registered for the offence punishable under Sections 3, 17(1), 18(2) of Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994. As per prosecution case, these petitioners were running pathological lab without having any license. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. From perusal of the FIR, lab in question was not found
Patna High Court CR. MISC. No.45344 of 2022(2) dt.06-12-2022 2/2 open nor in existence possession. As a matter of fact, petitioners had already deposited required fee of Rs. 3,000/- for license at the time when raid on the lab in question was conducted. Petitioners have got clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Govt. Official Complaint Case No. C2-06 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
