The petitioner has preferred this application for grant of regular bail in a case registered under sections 188 and 420 of the Indian Penal Code, sections 18(c), 18(a)(vi), 18, 18(B), 27(b) (ii), 27(d), 28 and 28A of Drugs and Cosmetic Act, sections 50 and 60 of the Disaster Management Act and Section 7 of the Essential Commodities Act.

As per the prosecution case, the petitioner was caught making an attempt to procure Remdesivir injection in the name of a patient who had already died.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. He is in custody since 7.5.2021 and has no

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner not having any criminal antecedent and having remained in custody for 11 months, the petitioner is directed to be enlarged on bail in connection with Kotwali P.S. Case no. 309 of 2021 (Special Case Drug & Cosmetic no. 02 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge (Drug & Cosmetic), Bhagalpur.
