Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in Jandaha P.S. case No.47 of 2017 vide S.T. No.608 of 2020 registered under Sections 323, 341, 498(A), 304(B), 504/34 of the Indian Penal Code, pending in the court of Additional Sessions Judge III, Vaishali at Hajipur. The earlier bail application of the petitioner was rejected vide Annexure 1series to the present application taking into account that the petitioner is the husband of the deceased and the onus is on him to explain the cause of death of the deceased.

Patna High Court CR. MISC. No.2521 of 2021(3) dt.24-03-2021 2/2 A report was called for from the court below regarding the stage of trial. It has been reported that the statement of the accused under Section 313 Cr.P.C. is to be recorded and the trial is likely to be concluded within a period of 40 days.

Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial at the earliest.
