2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 120B of the Indian Penal Code and Section 27 of the Arms Act. Later on, Section 302 of the Indian Penal Code was added. 3 . The prosecution case , in brief, is that informant namely, Harendra Singh alleged that on 07.08.2019, all the F.I.R. named accused persons along with some unknown persons armed with weapons came and co-accused Dharmendra Kumar fired upon informant. It is further alleged that this
Patna High Court CR. MISC. No.42844 of 2025(5) dt.21-11-2025 2/3 petitioner fired upon one Jaimangal Singh by country made pistol due to which he sustained gunshot injury on his chest and during course of treatment he died.
4. Learned counsel for the petitioner submitted that petitioner has got no concern with the alleged occurrence . At the relevant time , petitioner was working as manager of a Nursing Home and on the alleged date and time of occurrence , he was not present at the spot and this fact has also been supported by the witnesses during investigation . Police after thorough investigation submitted final form and differeing with the same the learned Trial Court has taken cognizance against this petitioner and others. Petitioner is in custody since 17.05.2025 .
5 . Learned A.P.P. for the State vehemently opposed the bail application and submitted that trial has already been started and 3 witnesses have been examined.
6. However, vide order dated 16.07.2025 , report of the trial was called for and from perusal of the trial Court report dated 12.09.2025, it appears that charge was framed in this case on 10.09.2025 and till date no witnesses have been examined.
7. Considering the aforesaid facts, materials available on record, period of custody and other circumstances of the
Patna High Court CR. MISC. No.42844 of 2025(5) dt.21-11-2025 3/3 case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class East Champaran Motihari in Motihari Muffasil P.
