Learned counsel for the petitioner has very fairly submitted that other retirement benefit has been paid to the petitioner and only the amount of pension has not been finalized due to certain defect in the pension papers. To that extent, he referred to certain averments made in the counter affidavit. In the considered opinion of this Court, if the petitioner is prepared to remove such defect in the pension papers, there should be no difficulty for the respondents to allow him to do so and, therefore, if the petitioner approaches the competent
Patna High Court CWJC No.4820 of 2014 (2) dt.07-04-2015 authority along with the copy of this order, the necessary correction in the pension papers will be allowed to be made by the petitioner, whereafter, necessary procedure would be completed for sanction and authorization of payment of the amount of pension.
This exercise, however, must be completed within a period of three months from the date the petitioner would complete the formalities of removal of the defect in the pension papers.
With the aforementioned observation and direction, this application is disposed of.
