JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Excise Case No. 820 of 2019 arising out of P.R. No. 28 of 201920, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018. The petitioner's prayer for bail was earlier rejected by this Court by an order dated 08.06.2020 passed in Cr. Misc. No. 10221 of 2020. It is alleged that from the truck, which the petitioner was found to be driving, 2610.720 liters of Indian Made Foreign Liquor was recovered. He has renewed his prayer for bail by making the present application.

Learned counsel for the petitioner has submitted that he is in custody since 10.11.2019. He has also submitted

Considering the submission that the petitioner has remained in custody since 10.11.2019 and there is no likelihood of the trial being concluded in near future, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 3rd-cum-Special Judge (Excise), Kaimur at Bhabhua, in Excise Case No. 820 of 2019 arising out of P.R. No. 28 of 2019-20.
