Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 224, 225, 353 and 120(B) of the Indian Penal Code.

It is alleged against the petitioner that she

Patna High Court CR. MISC. No.54211 of 2021(2) dt.08-04-2022 2/3 being wife of an apprehended accused namely Ajay Sharma had helped in succeeding away from the clutches of the informant being police away who has brought the accused to the Sadar Hospital, Purnea for necessary COVID-19 test.

It is submitted by learned counsel for the petitioner that the petitioner has been made accused in this case only because she happens to be the wife of coaccused Ajay Sharma and due to negligent and carelessness of the police personnel, the accused tried to set himself fee, for which, the petitioner cannot be held responsible. Moreover, no independent witnesses has supported the prosecution case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail

No.54211 of 2021(2) dt.08-04-2022 3/3 on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. Case No. 540 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
