The petitioners are apprehending their arrest in connection with Saharsa P.S.Case no.326 of 2014 registered for offences punishable under Sections 420B, 406 and 120B of the Indian Penal Code.
Allegation against the petitioner is that he deposited Rs.64,500/- for the purpose of taking loan from the petitioners' firm but now he is not giving loan and not returning the amount. Submission of the learned counsel for the petitioners is that they are ready to pay back Rs.64,500/- if he is given reasonable time.
Heard learned A.P.P. and the learned counsel for the
Patna High Court Cr.Misc. No.3433 of 2018 (4) dt.27-06-2018 2/2 informant. They have no objection.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of eight weeks from the date of receipt of the order along with the bank draft of Rs.64,500/- payable in the name of the petitioner and once it is deposited the learned court below shall release the petitioner to his own satisfaction otherwise he may pass any other order or orders.
No coercive steps will be taken against the petitioner for 08 weeks.
