JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2019 Earlier prayer for bail of the petitioner was rejected thrice by this Court, firstly vide order dated 17.11.2017 passed in Cr.Misc.No. 49517 of 2017, secondly vide order dated 28.3.2018 passed in Cr.Misc.No. 7666 of 2018 and thirdly vide order dated 2.1.2019 passed in Cr.Misc.No. 69358 of 2018 with liberty to the petitioner to move before this Court once the informant and his family members have been examined and submission is that the informant and his family members have been examined and they have been declared hostile and petitioner is in custody since 25.5.2017.

Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to learned trial court to verify the submission of

No.42328 of 2019(2) dt.11-07-2019 2/2 learned counsel for the petitioner and if it is true, petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Aurangabad, in connection with Sessions Trial No. 271/18/359/18, arising out of Navinagar P.S.Case No. 133 of 2017, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and petitioner has to cooperate in the disposal of trial and appear in court regularly except showing some genuine reason till conclusion of trial.
