JUSTICE KHATIM REZA ORAL ORDER 17-10-2025 Heard learned counsel for the petitioners, learned counsel for the complainant/ OP No.2 and learned Additional Public Prosecutor for the State.

2. The petitioners apprehend arrest in connection with Complaint Case No. 598 of 2024 dated 29-06-2024 instituted under Sections 420 and 504/34 of the Indian Penal Code.

3. As per prosecution case, the complainant/OP No.2, who is proprietor of K.K. Drug Agency, alleged that she had

Patna High Court CR. MISC. No.46662 of 2025(3) dt.17-10-2025 2/3 supplied medicines worth Rs. 1,62,55,392/- to the petitioners between April 2021 and May, 2023. In lieu thereof, the petitioner paid Rs. 81,99,379 and an outstanding amount of Rs. 80,55,913/- remained unpaid. When the complainant's husband approached the petitioner No.1 on 18.12.2023 and again on 30.04.2024 to demand the pending payment, the petitioners allegedly abused, assaulted and locked him in a room, as also threatened him with dire consequences. Later, on 20.06.2024, when the complainant personally met the petitioner No.2 for payment, petitioner no.2 flatly refused to pay the dues.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in the present case. It is further submitted that both the petitioners are doctors. The complaint case has been lodged by the complainant under Sections 420, 406, 120(B), 323, 504, and 506/34 of the Indian Penal Code; however, cognizance has been taken only under Sections 420 and 504/34 IPC. It is next submitted that the claim of the complainant is purely a civil dispute for recovery of Rs. 80,55,913/-. Lastly, it is submitted that the petitioners have no criminal antecedents.

5. Learned counsel for the complainant and learned APP have opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Aurangabad, in Complaint Case No. 598 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.

7. The application stands allowed.
