JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2017 The petitioner is apprehending his arrest in connection with Amba P.S. Case No. 21 of 2017, registered for offences punishable under Sections 147, 148, 149, 323, 324, 337, 338, 325, 307, 332, 333, 353, 379, 427, 504 of Indian Penal Code, Section 27 of Arms Act and Section 3 and 4 of Damage of Public Property Act.
It has been submitted on behalf of the petitioner that in this case large number of persons have been made accused and though petitioner is also named in the F.I.R., however no specific allegation of overt act has been attributed against the petitioner. It has further been submitted that petitioner runs a P.D.S shop there and has been made accused in this case. Further one of the coaccused having similar allegation, has already been granted bail by
Patna High Court Cr.Misc. No.16347 of 2017 (2) dt.08-04-2017 2/2 this Court.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances of the case and as he is named in the F.I.R and allegation against him that he was creating obstruction on the road and damaging property, though not specific, as such, in my opinion, this is not fit case for grant of anticipatory bail. Let petitioner surrender before the Court below and pray for regular bail and if any such application is filed, the court below after considering the fact that other co-accused having similar allegation has already been granted bail by this Court, shall pass an appropriate order, without being prejudiced by the order of this Court.
With the above observation, this application is disposed of.
