JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-11-2018 The present writ petition has been filed for quashing the order dated 31.12.2013 issued by the Sub-Divisional Officer, Bettiah Sadar-cum- Special Officer, Agriculture Produce Market Samiti, Bettiah whereby and whereunder the shed has been allotted on the platform to the respondent no.4 illegally. From perusal of the impugned order dated 31.12.2013 it appears that the said allotment was only for a period of eleven months which has expired long time ago. Moreover, the present writ petition is also barred by delay and laches inasmuch as the petitioner has sought to challenge the order of the year 2013 in the year 2017.
Having regard to the facts and circumstances of the
Patna High Court CWJC No.431 of 2017(2) dt.29-11-2018 2/2 case, there is no merit in the present writ petition, hence, the same is dismissed.
