The petitioner seeks bail in a case registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

Allegation against the petitioner alongwith other accused persons is said to have killed the daughter of the informant due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner is in jail custody since 23.06.2020 and has got no criminal antecedent.

Learned APP for the State opposes the prayer for bail petition of the petitioner and submits that the petitioner is

Patna High Court CR. MISC. No.39808 of 2020(3) dt.10-03-2021 2/2 husband of the deceased.

Considering the aforesaid facts and circumstances of this case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Ramgarh P.S. Case No. 106/2019 from the Court of learned Additional Chief Judicial Magistrate-1st, Kaimur at Bhabua.

Accordingly, this application is dismissed.
