JUSTICE RAJIV ROY ORAL ORDER 08-04-2022 Heard Mr. Rakesh Ranjan, counsel for the petitioner, Mr. Jitendra Kumar Singh, counsel for the State as well as Mr. Vijay Shankar Srivastava, counsel for the informant. The petitioner is an accused in connection with Keshariya P.S. Case No.250 of 2021 lodged under Section 354(A)(B) of the Indian Penal Code and Section 8 of the POCSO Act registered on 30.04.2021.

According to the FIR, the accused who is related to the victim girl being her uncle took her away and molested her. The same has also been supported by the victim girl under Section 164 of the Code of Criminal Procedure. Considering the grave allegation that a minor child has levelled against her uncle who was supposed to protect her being her guardian, this Court is not inclined to grant the

Patna High Court CR. MISC. No.54270 of 2021(2) dt.08-04-2022 2/2 privilege of bail to him, which is accordingly rejected. The counsel for the petitioner submits that the Trial is already going on and he prays that the same may be expedited. The Trial court is directed to conclude the Trial expeditiously without any unnecessary adjournment.

The bail application is rejected.
