The petitioners apprehend their arrest in Khagaul P.S. Case No. 139 of 2014 registered for the offences punishable under Section 366(A) and other Sections of the Indian Penal Code. The prayer for bail of the petitioners was earlier rejected vide order dated 23.06.2016 passed in Cr. Misc. No. 43028 of 2015. The petitioners again moved for grant of anticipatory bail on the ground that the case has been compromised.

It appears that the victim, herself, made statement under Section 164 Cr.P.C. and made specific allegation against both the

Patna High Court Cr.Misc. No.14681 of 2017 (3) dt.03-05-2017 2/2 petitioners that they kidnapped her and thereafter, petitioner no. 1 established physical relation with her. The case is noncompoundable. Considering the facts aforesaid and the facts that I do not find any fresh ground to reconsider the prayer for anticipatory bail of the petitioner.
