JUSTICE BIRENDRA KUMAR ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.

The petitioner is the owner of the vehicle from which stolen wire of the electric company was recovered. The driver and cleaner were arrested at the spot.

Submission of the petitioner is that he has got no criminal antecedent and has no knowledge as to what the drivers were carrying on the commercial vehicle.

Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.9735 of 2017 (3) dt.19-05-2017 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj/Successor Court in connection with Kishanganj Police Station Case No.455 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
