JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of the direction, order or writ, including writ in the nature of certiorari for quashing that part of the decision taken during the meeting of the Bihar Staff Selection Commission Patna (hereinafter referred to as the "Commission") held on 27.07.2016, by which it had been decided to return the requisition made to the Commission by the State Government for appointing auditors in different departments of the State Government notwithstanding the fact that the commission had already made recommendation of 266 candidates on the basis of their performance in the examination
Patna High Court CWJC No.16465 of 2021(2) dt.24-01-2024 2/3 conducted by the commission for the said purpose and as such persons have already been appointed and despite the fact that the present petitioner had also been declared successful his name has not been recommended by the commission in the most illegal and arbitrary manner.
(ii). For issuance of a direction order or writ including writ in the nature of mandamus commanding the concerned respondent authorities under the commission to take steps towards making recommendation for the consideration of the case of the present petitioner for appointment against the post of auditors in furtherance of advertisement no. 2407 issued by the commission against the existing vacancies in the different categories.
(iii). For issuance of the declaration holding that the present petitioner is entitled for being considered for appointment against the post of auditors in the office of registration, co operative societies Bihar Patna as well as the finance (audit) department of the State Government on the basis of their performance in the examination conducted by commission in furtherance of advertisement no. 2407 issued by the commission.
(iv). For issuance of direction order or writ, including writ in the nature of mandamus commanding the concerned respondent authority
Patna High Court CWJC No.16465 of 2021(2) dt.24-01-2024 3/3 of the state government to consider the case of present petitioner for appointing him against the post of auditors when the recommendation pursuant to advertisement no. 2407 issued are by the commission in favour of the present petitioner."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondents authorities for redressal of his aforesaid grievances. Liberty, so sought, is granted.
