The petitioner apprehends his arrest in Kasba P.S. case No. 07 of 2017 under Section 420, 406, 467,468, 120B and 34 of the Indian Penal Code.
The informant alleged that Deepak Kumar Choudhary executed a deed of agreement to sale in her favour with regard to land of plot No. 534, 535, 536, Khata No. 67, P.S. No.225, area four katha, Mauza, Fulwariya. Deepak Kumar Choudhary also received Rs. 3 lacs on different dates but did not execute the sale deed. Deepak Kumar Choudhary got land from the petitioner, Yuvraj Singh.
The learned counsel for the petitioner submits that though the name of the petitioner figured in the FIR but the
Patna High Court Cr.Misc. No.10810 of 2017 (2) dt.16-03-2017 2/2 informant did not make any allegation against the petitioner, who is land owner. The petitioner had no talk with the informant and he did not receive any farthing to execute any sale deed. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in Kasba P.S. Case No. 07 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
