JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2019 This application, for grant of anticipatory bail, arises out of Excise Case No. 251/2019, disclosing offences under Sections 30(a) and 30 (c) of the Indian Penal Code. Allegation is of recovery of 12 kilogram of java mahua and twenty liters of country made liquor, which were concealed beneath the land and the accused persons fled away. Submission of learned counsel for the petitioner is that he has no criminal antecedent and he has falsely been implicated in this case and the land from which, the recovery has been made does not belong to the petitioner. Learned counsel for the State opposed the prayer for bail, however, he could also not show anything that the land from which the recovery has been made, belongs to the

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Excise Case No. 251/2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
