JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-06-2017 Heard leaned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Gaunaha P.S. Case No. 07 of 2017 for the offence under Sections 20(b), 22 and 23 of the NDPS Act. It is alleged that 260 Gram Ganja recovered from the shop conducted by one Papu Kumar. From perusal of the F.I.R. it appears that the allegation against the petitioner is that he was running shop, whereas the statement of the petitioner is that, in fact, Papu Kumar was running the shop, where the Ganja was seized. In para-03 of the petition, it has been mentioned that petitioner has no criminal antecedent.
Having regard to the fact that 260 Gram of Ganja was recovered from the shop conducted by Papu Kumar and there

No.20114 of 2017 (2) dt.01-06-2017 2/2 is no criminal antecedent of the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the receipt or production of the order, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Bettiah, West Champaran or his successor Court in connection with Gaunaha P.S. Case No. 07 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Upadhyay, J) manish/- U T
