The petitioners apprehend their arrest in connection with Pathamari P.S. Case No.12/16 registered under Sections 147, 148, 341, 323, 325, 307, 332, 333 and 353 of the Indian Penal Code.

Learned counsel for the petitioners submits that it would appear from the F.I.R. itself that the occurrence of mar pit took place between two groups in which persons of both the parties sustained injuries. Moreover specific overt act has been attributed against the petitioners. It is further submitted that similarly situated co-accused, Gulam Husnain, Gulam Awesh,

Patna High Court Cr.Misc. No.12822 of 2017 (2) dt.11-04-2017 2/2 Gulam Nomani, Shoib Alam and Gulab have already been granted privilege of anticipatory bail by this Court vide order dated 11.08.2016 passed in Cr. Misc. No.32418/16.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri K.K.Chaudhary, J.M. 1st Class, Kishanganj, in Pathamari P.S.

Case No,12/16 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
