JUSTICE SUDHIR SINGH ORAL ORDER 05-01-2022 Due to the third wave of COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding. The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy. The petitioner seeks bail in Sessions Trial No. 155 of 2018 arising out of Kishanganj P.S. Case No. 625 of 2017 registered under Sections 363, 365, 302, 379, 411, 201/34 of the Indian Penal Code.
Earlier prayer for bail of the petitioner was rejected taking into account that on the basis of self-confession of the petitioner, printer metre of the deceased was recovered from his house.
Patna High Court CR. MISC. No.54232 of 2021(3) dt.05-01-2022 2/3 On behalf of the petitioner, it has been submitted that the petitioner is in custody since 25-11-2017. There is no allegation of tampering of witnesses alleged against him nor there is any criminal case pending against him. There is no eye witness to the alleged occurrence. The petitioner has already remained in custody for more than four years.
A report was called for from the trial court. It has been reported that out of 14 prosecution witnesses, eight prosecution witnesses have already been examined. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the period undergone, the petitioner is directed to be released on bail on his personal bond to the satisfaction of learned Sessions Judge, Kishanganj in connection with Sessions Trial No. 155 of 2018 arising out of Kishanganj P.S. Case No. 625 of 2017.
Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of eight weeks to the satisfaction of the court concerned in connection with the aforesaid case.
The petitioner is directed to cooperate during trial. If the
