This is a petition for grant of anticipatory bail for offence under Sections 147, 148, 149, 342, 323, 324, 325, 332, 353, 307, 186, 504 and 506 of the Indian Penal Code. According to first information report, a motorcyclist died in a road accident. The infuriated mob either attempted to burn the vehicle or set the vehicle on fire. The petitioner was identified amongst the mob. Submission of the petitioner is that similarly situated co-accused, Naresh Yadav and Lalit Yadav, have already been allowed anticipatory bail by coordinate Benches of this Court in Cr. Misc. No. 51874 of 2016 and 52751 of 2016.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be
Patna High Court Cr.Misc. No.15415 of 2017 (2) dt.20-04-2017 2/2 released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Hasanpur P.S. Case No. 86 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, III, Rosera, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
