====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-07-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Baikunthpur P.S. Case No. 99 of 2016 registered under Sections 302, 210 and 498A of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that earlier prayer of the petitioner for bail was rejected by this Court vide order dated 10.02.2017 passed in Cr. Misc. No. 54112 of 2016 in view of the fact that charge-sheet has been submitted against the petitioner. Further submission of learned for the petitioner is that in fact, no charge-sheet has been submitted against the petitioner, therefore, a fresh ground arises for consideration of second anticipatory bail application of this petitioner. It is also submitted that similarly situated co-accused
Patna High Court Cr.Misc. No.5778 of 2018(6) dt.11-07-2018 2/2 namely, Alka Kumari, has already been allowed bail by this Court vide Cr. Misc. No. 30258 on 13.12.2017. Hence, the petitioner may be enlarged on bail.
Considering the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Gopalganj in connection with Baikunthpur P.S. Case No. 99 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
