The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 504 & 506 of the Indian Penal Code. Over brawl taken place during immersion of Godess Saraswati between Rajput and Yadav community, while the informant had gone to Kali temple to offer worship, six name accused persons including the petitioners started slating him and on forbidding from slating on exhortation of Sahdeo

Patna High Court CR. MISC. No.46342 of 2019(3) dt.17-10-2019 2/2 Yadav Narayan Yadav resorted firing on the chest of the informant by country made pistol inflicting injury to him. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have been falsely implicated in this case due to animosity. They do not happen to be assailant rather the assailant is Narayan Yadav. Moreover parties to the case have compromised the matter. Petitioner nos.1, 2 & 3 have no criminal antecedent albeit petitioner no.4 has one criminal antecedent but he is on bail in the said case. Learned APP for the State opposed the bail petition.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Jamui in connection with Sikandra P.S. Case No. 43 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
