The petitioner seeks bail in connection with Bahadurpur P.S. Case No. 03 of 2026 instituted for the offence under Sections 126(2), 115(2), 74, 109, 351(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

Prosecution case in short is that on 11.03.2026, the accused persons came armed to the informant's kirana shop, assaulted the informant's wife, fired at her causing injury, and also fired at the informant before fleeing from the spot. The reason for the alleged motive is that the informant had earlier instituted a criminal case against the accused, who were

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.04.2026. Petitioner bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. From perusal of the FIR, it would reveal that there is no specific allegation against the petitioner, rather the same is attributed to co-accused, namely, Dinesh Yadav. Nothing has been recovered from the conscious possession of the petitioner. There is no compliance of Section 103 of the BNSS, 2023. Charge sheet has already been submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
