Petitioner apprehends arrest in connection with Town (Sahayak) P.S. Case No. 283 of 2021 registered for the offence under section 302 and other allied sections of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. Nothing specific is alleged against this petitioner. The specific allegation is against co-accused Vishal Yadav. As a matter of fact, the staff of the hotel of the petitioner's mother had lodged a case against the deceased and his associates for committing loot and of opening indiscriminate firing vide Town
Patna High Court CR. MISC. No.44927 of 2022(7) dt.16-05-2023 2/2 (Sahayak) P.S. Case No. 168 of 2021, as contained in Annexure5 to the supplementary affidavit. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Town (Sahayak) P.S.
