JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-11-2021 Heard the learned counsel for the petitioner and Ms. Anita Kumari Singh, learned APP appearing for the State. The present petition has been filed seeking modification of the order dated 23.01.2021, passed in Cr. Misc. no. 86013 of 2019, as far as the petitioner herein i.e. petitioner no. 6 of the said case is concerned, to the extent that the time granted for surrendering before the learned court below and availing the privilege of anticipatory bail be extended by a further period of four weeks from today.

The learned counsel for the petitioner has submitted that the petitioner herein who was petitioner no. 6 in the aforesaid Cr. Misc. no. 86013 of 2019 lives outside the State of Bihar, hence on account of Covid-19 Pandemic, he had some difficulty in approaching the learned court below within the prescribed time for the purposes of surrendering and availing the privilege of

Patna High Court CR. MISC. No.54655 of 2021(2) dt.17-11-2021 2/2 anticipatory bail, hence the time granted to the petitioner for surrendering be extended by a period of four weeks from today. The learned APP for the State has got no objection, in case the time granted to the petitioner to surrender is extended. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to modify the order dated 23.01.2021, passed in Cr. Misc. no. 86013 of 2019, as far as the present petitioner is concerned, to the extent that the petitioner would be entitled to surrender before the learned court below i.e. the court of Chief Judicial Magistrate, Samastipur in connection with Waris Nagar PS case no. 33 of 2019, within a period of four weeks from today in order to avail the privilege of anticipatory bail. The rest of the conditions shall remain the same as have been prescribed in the order dated 23.01.2020.

The order dated 23.01.2021, passed in Cr. Misc. no. 86013 of 2019 stands modified to the aforesaid extent, as far as the petitioner herein is concerned.

The present petition stands disposed off.
