JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Daudnagar P.S. Case No. 118 of 2016 registered for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code.

It is submitted on behalf of the petitioners that in the first information report there is no specific allegation against the petitioners and in last line only it has been alleged that the petitioners were also involved in assaulting and moreover the informant has filed compromise petition also vide annexure-2 in the court of learned Sessions Judge, Aurangabad at the time of hearing of B. P. No. 1040 of 2016, there is case and counter case and now good sense has prevailed between the parties.

Patna High Court Cr.Misc. No.7012 of 2017 (2) dt.23-02-2017 Learned APP fairly submits that against the petitioners there is no specific allegation.

In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 118 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
