2. The petitioner apprehends arrest in connection with Dumariyaghat P.S. Case No. 276 of 2023 dated 20.10.2023 instituted for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

3. The allegation against the petitioner is that he along with other accused persons assaulted repeatedly the informant by means of iron rod. It is further alleged that they also assaulted the son of the informant and snatched gold jewellery. Co-accused Bacha Singh assaulted the informant by means of sharp cutting weapon causing head injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that both the sides are agnates. There is no specific allegation against the petitioner. Allegation against the petitioner is general and omnibus. There is case and counter case between the parties. Counter case bearing Dumariyaghat P.S. case No. 275 of 2023 has been lodged by the petitioner's side against the informant and others. Coaccused Bacha Singh has been granted anticipatory bail vide order dated 24.07.2024 passed by co-ordinate Bench of this Court in Criminal Miscellaneous No. 44920 of 2024. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. On the other hand, learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Dumariyaghat P.S. Case No. 276 of 2023, he will be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran
