This application, for grant of anticipatory bail, arises out of Narari Kala Khurd Police Station Case No. 40 of 2017, disclosing offences under Sections 406, 420 and 409 of the Indian Penal Code.

Allegation against the petitioner that he on the basis of forged certificate of B.ed obtained the job of a teacher in Upgraded Middle School, Saduri Karma and when it was came to light, he was removed from service and a direction was issued to recover the entire amount, which was paid to him as salary but he is not returning the said money.

Submission of learned counsel for the petitioner that

No.17264 of 2018 (3) dt.03-05-2018 2/3 he has not intentionally filed the forged certificate and when he came to know that the institution, from which he obtained the B.Ed. degree was not registered, he informed the authorities and on the basis of his merit, he was allowed to continue on the post of teacher but subsequently, he was removed from service, which will appear from F.I.R.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad, in connection with Narari Kala Khurd Police Station Case No. 40 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.

The petitioners shall cooperate in the investigation and make himself available as and when required by the police and on the
