The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 341, 323, 324, 326, 307, 448, 354(A), 354(B), 504 and 436 of the Indian Penal Code. The prosecution case, in brief, is that on 2.8.2016 at 7:00 P.M,.the informant was cooking meal inside the house along with his brother, in the meantime the accused persons including the petitioners entered in her house and started teasing, which was opposed by her brother Jay Shankar Kumar Singh. Upon which co-accused Rohit Singh gave farsa blow on left hand of Jai Shankar Kumar Singh causing injury and then co-accused Brahma
Patna High Court Cr.Misc. No.15396 of 2017 (2) dt.07-04-2017 2/3 Singh gave farsa blow on his right hand causing injury. Thereafter the accused persons sprinkled kerosene oil and set fire in the house of the informant. The informant anyhow came outside from the house to save her life. Her brother was taken to the Hospital for treatment.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. It is a case and counter case between the parties. Due to property dispute the alleged occurrence is said to have taken place. The specific allegation has been made against the coaccused, namely, Brahma Singh and Rohit Singh. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Ramgarhwa, East Champaran in connection with Ramgarhwa P.S. case No.82 of
