JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mali P.S. Case No. 24 of 2019, registered for the offences punishable under Sections 363, 366, 497, 498, 504, 120(B) and 376 of the Indian Penal Code. It is alleged that petitioner kidnapped the wife of informant on the pretext of marriage.

It is submitted by learned counsel appearing on behalf of petitioner that petitioner is innocent and has falsely been implicated in this case. Petitioner is Dewar of the victim. It appears that there is specific allegation against this petitioner. The victim also disclosed in her statement under Section 164 Cr.P.C that petitioner forcibly established physical relation with her and played active role in kidnapping her.
