The petitioners apprehend their arrest in Alamnagar P.S. Case No.271/2017, registered under Section 366A read with Section 34 of the Indian Penal Code.

The informant named the petitioners along with other accused persons and alleged that Prashant Kumar with the help of the petitioners kidnapped the minor daughter of the informant. Learned counsel for the petitioners submits that the petitioners are Aunt of Prashant Kumar. The informant is not an eyewitness to the alleged occurrence. On mere suspicion, the entire family members of Prashant Kumar have been implicated in this case.

Patna High Court Cr.Misc. No.17986 of 2018 (3) dt.17-05-2018 2/2 Learned Additional Public Prosecutor after perusing the case diary submitted that no tangible material has been collected against the petitioners.

Considering the nature of the allegation made against the petitioners and the facts that the petitioners are Aunt of Prashant Kumar, who is alleged to have kidnapped the victim, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Udakishunganj, in connection with Alamnagar P.S. Case No.271/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
